What is Intellectual Property

What is Intellectual Property

Intellectual Property or IP is a legal concept that includes trademarks, copyrights, patents, and other related rights. The holder of intellectual property has exclusive rights to their creative work, commercial symbol, or invention. Some governments recognized forms of intellectual property for a few centuries and other governments have recognized intellectual property only recently.

Some parts of intellectual property include trademarks, copyrights, and patents. Trademarks are a word, name, symbol, or device that is used in trade of goods to indicate the source of the goods and to distinguish them from other similar goods. Trademark rights can be used to prevent others from using the same or similar words, names, symbols, or devices. Copyrights are a word, phrase, symbol, or logo used to identify a product and the source of the product or the manufacturer or merchant. Patents is a legal grant issued by the government permitting an inventor to exclude others from using, making, or selling a claimed invention. Patents run 20 years from the filing date.

Other intellectual property topics include trade secret misappropriations, patenting computer software, patent law, copyright law, and copyright fair use laws. A trade secret is known as any information relating to business, finances, science, technology, engineering, or economy that can be stored electronically, graphically, photographically or in writing. Trade secrets in general entail information that is not widely known and can present an advantage of some sort to the owner or the general public. Some possible trade secrets include patterns, programs, codes, devices, procedures, compilations, prototypes, methods, and techniques. Copyright laws grant protection to the original works of authorship. Trade secret laws protect important information that is not commonly known to the public.

Personal Injury Law

Personal Injury law

Accidents can readily occur at any moment and without any warning. It does not make a difference if you are at work, on the road, or even in the comfort of your own home, anybody can end up injured. Personal injuries even occur when a responsible person is taking all the proper precautions. In most of these cases, the physical injuries sustained are minor. However, in some cases, the resulting injuries are more serious, and can even leave an individual with permanent debilitating conditions or even claim their life. The financial burden imposed on the victims of a personal injury case, which often includes medical expenses and loss of wages, can be overwhelming for some. For this reason, personal injury laws entitle victims of an accident to compensation for their financial losses and pain and suffering if there is proof of negligence on the behalf of the second party involved.

The most common personal injury cases include:

Traffic Accidents: Traffic accidents are vehicle-related incidents that result in either personal injury and/or property damage.

Work Accidents: Work accidents occur during working hours in which an employee suffers damages to their health or loss of life.

Slip and Fall: Slip and fall accidents are the result of negligence by a property owner in which he or she permitted dangerous conditions to exist that caused an individual to slip, trip, or fall.

Assault Claims: Assault claims are any intentionally or voluntarily violent act against another individual.

Product Liability: Product liability occurs when manufacturers, merchants, or distributors of a specific product are liable for any damages stemming from the use of their product.
Structured settlements are often used in many personal injury cases to ensure financial stability over a long period, or in some cases, for the rest of the victim’s life. Structured settlement payments are directly made to the plaintiff over fixed periods

Employment Law

Employment Law
Employment law includes the laws covering the relationships between employers and employees. Employment laws include federal and state laws, statutes, and regulations. State and local governments established many of these employment laws to protect employees. The most common form of employment laws addresses discrimination and workers compensation policies. Employment discrimination laws prohibit all forms of discrimination including discrimination based on gender, religion, ethnicity, disability, age, sexuality, and/or nationality. Discriminatory comments, harassment, and racial bias are a few variations of discrimination that occur in the workplace. Unfortunately, discrimination within the workplace occurs daily. For this reason, the government created the U.S. Equal Employment Opportunity Commission (EEOC). If a complaint reaches the EEOC concerning a business or employer, the agency’s responsibility is to investigate the situation. The EEOC, following the preliminary investigation, may pursue violations pursuant to employment law.

The EEOC frequently settles employment disputes through mediation. This process begins with a neutral third party present to assist in negotiations. Thus, mediation is as a form of alternative dispute resolution. Mediation has many positive factors contributing to the resolution of employment disputes. A few of these benefits include the ability to save time and money. Mediation decisions and agreements remain closed as well. Plaintiffs and defendants also like avoiding the cost of litigation by using mediation methods.

Divorce law

Divorce law

A divorce, also referred to as, the dissolution of a marriage is a court ordered conclusion of a previously legitimate marriage. If they wish to do so, each party will legally be able to remarry in the future once the dissolution of a marriage is final. The division of assets and property are also determined within the court ruling and can waiver in either party’s favor, but commonly consist of an equal split of the assets accumulated during marriage between the two parties involved. The division of assets and property can include items such as cars, homes, and businesses. Keep in mind that a divorce can encompass the division of debt as well. One such example is that of credit card debt. When both parties’ names are on a joint credit card, the debt may be divided between the two parties. Contrary to popular belief, most divorces do not have to go before a judge to separate assets or to negotiate the terms of the divorce. Usually, this process takes place in a meeting with the attorneys from both parties. Another option is that of mediation, which can also help avoid the possibility of court and/or dispute.

A no-fault divorce consists of a divorce where neither the wife nor the husband blames the other for their inability to hold the marriage together. All states offer no-fault divorce, yet, only a few states deem this type of divorce as an adequate procedure for the dissolution of marriage. Examples of no-fault divorce include those of irreconcilable differences, incompatibility, irretrievable breakdown, and/or prolonged separation. Not every state offers fault-based divorces. Some examples of fault-based grounds for divorce are those of physical cruelty, adultery, drug use, and desertion.

Other factors that may be included within a divorce or dissolution of marriage are those of child custody arrangements and child support/child maintenance. The criteria for these factors vary and the process can prove to be a complex, as well as emotional. Child custody determines the parent who is legally responsible and able to make decisions for the child. Child support, on the other hand, consists of periodic payments made by the non-custodial parent to the custodial parent. These payments are to help pay for expenses of caring for a child or children. The majority of divorce cases involving children can be emotionally straining for the parents as well as the children. For this reasons the court gives custody to the party they believe will be the most fit as a custodial parent.

Medical Law

Medical Law
Medical law is a wide legal category that includes any injury that occurs to a patient because of the negligence or carelessness of a doctor, nurse, psychologist or any other medical professional. Any medical professional who provides inadequate health care and/or fails to perform his or her duties according to appropriate medical practices or standards of care in the medical community, commits medical malpractice. Medical malpractice injuries can take many forms, including the misdiagnosis of disease or condition, failure to notify the patient of inherent risk with a certain procedure or drug, prescribing the wrong drug or dosage, or negligently performing a procedure.

Nurses, surgeons, physicians, pharmacists, health care technicians, hospitals, managed care organizations such as Health Maintenance Organization (HMO) and Preferred Provider Organization (PPO) all may be held liable for any personal injuries involving medical malpractice.

When negligence results in injury, a medical malpractice cases may be brought against the hospital, clinic or any entity or person with whom there is a medical care provider/patient relationship. Legal actions can be taken for compensation when medical malpractice occurs. Patients take legal action in cases where the doctor’s actions deviate from general accepted standards of practice. Other legal actions are taken because of improper hospital care or inadequate training, such as problems with medications or sanitation. Also, patient may take legal action against the state, local or federal agencies that operate hospital facilities.

Medical malpractice is determined by laws and these laws are designed to protect the patients’ right to seek compensation if they are injured as result of negligence. However, some medical malpractice lawsuits are often complex and costly to win. Medical malpractice actions are tremendously difficult to pursue. The insurance companies have to pay out claims on behalf of the physicians and other medical professionals or the medical care facilities they represent and they aggressively defend the clients and institutions they cover from legal claims.

Traffic Violation

Traffic Violation
Almost everyone in their lifetime will, at one point, receive a traffic violation citation. Even if the traffic violation is a mild offense, it can still result in costly fees, insurance hikes, and wasted time on your part. Overall, a traffic ticket usually results in a nuisance and major hassle. Not only does a traffic violation come with a required fee, it can also result in points on your license. Points can cause insurance rates to sky rocket – and an accumulation of points can result in suspension or revocation of your license. Having a traffic violation professional, such as a lawyer, fight your ticket in court is the best way to avoid these issues.

In general, a traffic violation will fall under one of two categories – major or minor. Examples of minor traffic violations include running a red light, running through a stop sign, or speeding. Examples of major traffic violations include reckless driving and driving under the influence of drugs and/or alcohol. Even the most minor of traffic offenses carries with it some type of consequence. In most situations, a traffic ticket is issued, but in more serious situations such as drunk driving, the offender is arrested.

Most of time when a ticket is issued for a traffic violation, people choose not to fight the ticket in court or even to have an attorney represent them because they feel it is all too much of a hassle and they would rather just pay the fine and get it over with.

However, keep in mind that simply paying the ticket is like admitting you are guilty to the offense. Even if you knew you were driving a little over the speed limit or ran that stop sign, it is still not something you want to admit guilt to. This is when the points come are assessed, which will affect your license and driving record, insurance rates, and even your job if it involves operating any type of motor vehicle.

Real Estate Law

Real Estate Law

There are two types real estate law

  • Commercial
  • Residential

Real estate law deals with the legal proceedings that surround land ownership and the parcels that are part of it. Real estate law is divided primarily into two sections, residential and commercial.

Residential real estate law pertains to the legal right to own (or lease) property that is deemed for the habitation of people. There are many different forms of residences such as: houses, condominiums, duplexes and mobile homes just to name a few. Real estate law attorneys are typically retained by both the buyer and seller of a property to negotiate the contractual language that will be part of a sale. The attorney will also ascertain if the potential seller owes outstanding taxes on the land which, depending on where the transaction takes place, must be incurred by the new owner if not resolved. Typically, in a residential lease agreement situation, only the seller would retain a real estate lawyer to help draft the contract that the potential tenant must agree to before establishing residence on a property. These contracts typically include rules that the lessee must adhere to in order to maintain occupancy of a property.

Commercial real estate law typically concerns property with four or more residences comprising it. It also involves property used in the operation of businesses. Commercial real estate for business usage comes in host of different forms such as office buildings, industrial complexes and retail stores. In these instances, the real estate is typically leased. Commercial real estate law is typically more situationally specific in that the contract language is more elaborate. Lease agreements are actualized over a much longer time frame than residential transactions and the parameters are customized on a case by case basis. Certain elements such as zoning restrictions and profit sharing are subtleties that can exist in a commercial real estate contract that may not ever appear in a residential real estate contract.

Environmental Law

Environmental Law
Environmental law is a very broad and complex compilation of laws and legal issues that consists of statues, treaties, regulations, common law, conventions, and policies enacted to protect the natural environment from the impact of our affects on nature, or from the unnatural perils created by human activities. The policies designed to protect the environment include safeguards and management of ecosystems, terrain, public land, water systems, and air quality from the corruption or contamination by chemical substance, hazardous wastes, and other pollutants. Several environmental laws regulate the amount and kind of impact from human activities. For example, environmental law regulates the amount or level of pollution on a particular system, or by requiring permits or authorization for potentially harmful activities. Other environmental laws are constructed to protect nature by trying to determine or prevent any possible negative impact before the human activities can take place.

Environmental law arose in the 1960s in the major industrial economies. While many countries worldwide have since build up extraordinary sets of environmental laws, their implementation has been deplorable in many cases. Recently, environmental law has become a very serious way of promoting sustainable development. Progressive policy concepts such as the public involvement, preventive measures, quality standards, environmental justice, and the polluter pays principle have encouraged several environmental law reforms in this respect. There has been substantial experimentation done in the quest for a more effective method of environmental control beyond the traditional practice of "command and control" style regulation.

Business Law

Business Law
Business law (also known as commercial law) is the area of law that dictates and interprets the rules and regulations regarding commerce, business matters, and business transactions. This area of law has many facets that deal with matters such as, employment practices, contractual issues, the manufacturing and distribution of goods and services as well as intellectual property rights just to name a few.

Business law, pertaining to contracts, monitors the fulfillment of financial obligations readily agreed upon in those contracts. Lawyers who handle contracts for businesses or corporations typically participate in the drafting, editing, and execution of these agreements. They make sure that all the parties named in the contract adhere to the outlined stipulations and assist in making changes when necessary. For example, buying or selling a company typically demands the participation of a business law attorney that will draft a contract on behalf of the seller outlining the previous, verbally agreed upon guidelines. The buyer will also have a business lawyer review the drafted contract and each attorney will follow through to ensure the proper execution of the contract.

Another function of a business attorney is to make sure that certain contracts or transactions proceed according to the laws that govern that particular area. For example, if someone was to open a bar or nightclub in a certain area or community, a business law attorney would review possible zoning laws that may prohibit a business of that type to operate in a certain area based on restrictions that the local government has established. Laws of this type are always different from community to community and can evolve from the local, state, and federal levels. It is important for business law attorneys to be well versed in all of these areas.

What is Wrongful Death

What is Wrongful Death

A wrongful death is frequently caused by the irresponsibility and/or negligence of one person in charge with the care of another person. A wrongful death claim is a specific legal claim in a civil court brought against an individual who can be tried for the death of another person. The case is usually initiated by friends or family of the victim in question, and this is perfectly legal under the statues set for wrongful death lawsuits. Under the current statues, when certain irresponsible actions have caused a person harm the victim can bring a personal injury case against the offender. But if that same person’s actions against the victim caused the death of the victim, a personal injury case would not stand up in court. The family of the deceased must now bring a wrongful death case against the offender.

The level of evidence needed in the American court system is normally relevant to the contrasting proof of the obvious and credible or enough to leave no room for reasonable doubt. Because of this reason, it is much easier for the loved ones of a victim to appoint a lawyer and seek out recompense from the person who is responsible for the death of that family member than to try and go through the court system without the proper representation. However, it should be noted that an individual may be legally charged in criminal court with causing someone's death whether the charge is manslaughter, negligent homicide, or murder and that individual may also have a civil lawsuit brought against them apart of the criminal charges. Originally, there was no law to recuperate civil compensation for the wrongful death of a family member in any legal jurisdiction. All U.S. courts have since created and enacted the civil right to compensation that allows for such legal healing. The concern of responsibility will be determined by the court of a given state. There are many different actions that can bring about a wrongful death claim.

Love relationship

Love relationship
What is it about the people to whom we are most attracted that gives them the greatest potential to satisfy our deepest longings, while at the same time, the greatest likelihood to frustrate us? This is because of an unconscious image of the opposite sex which we carry deep within our mind. This image began to develop in infancy, and became fairly complete in later childhood.

That image, that mental picture, that map programmed in our unconscious mind affects both the type of person we select as a primary love partner in adult life and how we relate to them. That image is actually a synthesis of the positive and negative traits of our primary caregivers, relating to how well our early needs were met. As children, we did our best to get our caregivers to meet our needs. In most cases, our caregivers did the best they knew how to meet our needs. However, no matter how adequate our caregivers were, they could not and did not meet all our needs all the time, and that left us frustrated some of the time. Each frustration, each pain, left an imprint. Each imprint became part of a picture in that deep part of our unconscious mind. So the picture or image of the opposite sex which we formed was a combination of our caregivers' positive and negative characteristics.

When we choose a partner for a romantic relationship, we pick someone who matches the image in our unconscious. For practical purposes, our current partner is a psychological replacement of our childhood caregivers. The unfinished business, the unmet needs and emotional wounds with the early caregivers became a compelling agenda with our adult partner. The early childhood pain and frustration is unconsciously recreated with an adult partner possessing the same or similar negative traits as our early caregivers. The purpose of this unconscious recreation is expressly to bring the impasse to a resolution, to work through and heal the early pain.

Networking

Networking is the practice of linking two or more computing devices together for the purpose of sharing data. Networks are built with a mix of computer hardware and computer software.

Networks can be categorized in several different ways. One approach defines the type of network according to the geographic area it spans. Local area networks (LANs), for example, typically reach across a single home, whereas wide area networks (WANs), reach across cities, states, or even across the world. The Internet is the world's largest public WAN.

Network Design
Computer networks also differ in their design. The two types of high-level network design are called client-server and peer-to-peer. Client-server networks feature centralized server computers that store email, Web pages, files and or applications. On a peer-to-peer network, conversely, all computers tend to support the same functions. Client-server networks are much more common in business and peer-to-peer networks much more common in homes.

A network topology represents its layout or structure from the point of view of data flow. In so-called bus networks, for example, all of the computers share and communicate across one common conduit, whereas in a star network, all data flows through one centralized device. Common types of network topologies include bus, star, ring and mesh.
Network Protocols
In networking, the communication language used by computer devices is called the protocol. Yet another way to classify computer networks is by the set of protocols they support. Networks often implement multiple protocols to support specific applications. Popular protocols include TCP/IP, the most common protocol found on the Internet and in home networks.

Wired vs Wireless Networking

Many of the same network protocols, like TCP/IP, work in both wired and wireless networks. Networks with Ethernet cables predominated in businesses, schools, and homes for several decades. Recently, however, wireless networking alternatives have emerged as the premier technology for building new computer networks.

Insurance Introduction

  Insurance Introduction
Life is full of risks and accidents. People are at risk for getting injured when playing sports, riding in a car, or living in a house. Risk is uncertainty about a situation’s outcome. Risk can be unpredictable events which lead to loss or damage. Insurance is an arrangement between an individual (consumer) and an insurer (insurance company) to protect the individual against risk. Insurance plays a large role in most individual’s financial management plans.

Premium—the fee paid to the insurer to be covered under the specified terms.

Deductible—the amount paid out of pocket by the policy holder for the initial portion of a loss before the
insurance coverage begins.

Policyholder—the consumer who purchased the policy

1. Liability insurance—covers the insured if injuries or damages are caused to other people or their property; it is the minimum amount of insurance required by law for automobiles.

2. Medical payment insurance—covers injuries sustained by the driver of the insured vehicle or any passenger regardless of fault; also covers insured family members injured as passengers in any car or if they are injured while on foot as a pedestrian or while riding a bicycle.

3. Uninsured or underinsured motorists insurance—covers injury or damage to the driver, passengers, or the vehicle caused by a driver with insufficient insurance.

4. Physical damage insurance—covers damages caused to the vehicle; two optional forms of coverage are available

Malignant mesothelioma

Malignant mesothelioma

Malignant mesothelioma is an aggressive cancer with no known cure, which has become a therapeutic challenge. Onconase is one of few chemotherapeutic agents that have been studied in patients with malignant mesothelioma that has the advantage of low toxicity and limited side effects. Here, we evaluate the effect of Onconase on killing of malignant mesothelioma cells and how the phosphatidylinositol 3-kinase/AKT (PI3-K/AKT) survival pathway influences this effect. Our results show that Onconase induces apoptosis in malignant mesothelioma cell lines and that this effect is tumor cell specific. Malignant mesothelioma cell lines with the highest AKT activation, which correlated with the presence of the SV40 large and small T antigen (SV40+), were the most resistant to the drug. Finally, a cooperative effect was observed between small molecule inhibitors of PI3-K and Onconase in the killing of malignant mesothelioma cells. Our results suggest that kinase screening of individual malignant mesotheliomas for endogenous levels of activated PI3-K/AKT may be predictive of the efficacy of Onconase and possibly other chemotherapeutic agents

The processes involved in the initiation and development of malignant mesothelioma, a malignancy derived from pluripotent mesothelial cells with a variety of tumor phenotypes, including epithelial, sarcomatous, and mixed varieties (1), are under intense investigation (2). This unique tumor has been associated historically with occupational exposures to amphibole types of asbestos (1, 3). In the past few years, SV40, a DNA virus, has been linked to the etiology of mesothelioma. Multi-institutional studies show that ∼50% of human mesotheliomas in the United States contain SV40 large T-antigen DNA sequences (4, 5). Although malignant mesothelioma is a relatively rare cancer, its incidence is increasing in several countries (6). More important, the prognosis of patients with mesothelioma is grim as most survive <1 year after initial diagnosis (1, 3). Thus, effective therapeutic strategies are desperately needed.

Current treatment modalities include surgery, chemotherapy, and radiation therapy (7) and several new investigational approaches are now being tested, including intrapleural IFNγ, photodynamic therapy, immunotherapy, and gene therapy. Whereas some believe that radical surgical resection is the only chance of cure or meaningful improvement in survival, the majority of patients presenting with malignant mesothelioma are not candidates for radical surgical resection due to unresectable tumors or medical illness (8). As alternatives or complements, many chemotherapeutic agents have been studied in patients with malignant mesothelioma, either as single or combined agents, but low response rates have been found in most studies with the highest response rates generally achieved using combined treatment regimens (8). No clear standard of care has emerged and in most cases palliative treatment is used as the primary means of therapy (9).

Cytotec

Cytotec

This is  oral tablets contain either 100 mcg or 200 mcg of misoprostol, a synthetic prostaglandin E1 analog.
Misoprostol contains approximately equal amounts of the two diastereomers presented below with their enantiomers indicated by (±):
Cytotec (misoprostol) is indicated for reducing the risk of NSAID (nonsteroidal anti inflammatory drugs, including aspirin)–induced gastric ulcers in patients at high risk of complications from gastric ulcer, e.g., the elderly and patients with concomitant debilitating disease, as well as patients at high risk of developing gastric ulceration, such as patients with a history of ulcer. Cytotec has not been shown to reduce the risk of duodenal ulcers in patients taking NSAIDs. Cytotec should be taken for the duration of NSAID therapy.
Used
Cytotec for reducing the risk of NSAID-induced gastric ulcers is 200 mcg four times daily with food

Patient should not  give cytotec   anyone else . Cytotec has been prescribed for the patient's specific condition, may not be the correct treatment for another person, and may be dangerous to the other person if she were to become pregnant.
The Cytotec package the patient receives from the pharmacist will include a leaflet containing patient information. The patient should read the leaflet before taking Cytotec and each time the prescription is renewed because the leaflet may have been revised.

Special for women's
Cytotec may cause abortion (sometimes incomplete), premature labor, or birth defects if given to pregnant women.
